Acceptable Use Policy

All accounts held with Tinyhosts.com are subject to the Acceptable use Policy laid out below. Under the terms of this agreement your use of Tinyhosts services is an acknowledgement that you have read and agreed to these terms and conditions

Tinyhosts provides web hosting services to a large number of clients and as an ethical and well respected company we have a responsibility to protect each client and provide the best services available. The terms and conditions govern all of our web hosting services, we encourage you read them carefully before ordering.

Content
All services provided by Tinyhosts may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes.

Tinyhosts is not responsible for any claims resulting from the use of our services. This is also true for sites that promote any illegal activity or content that may be damaging to Tinyhosts servers or any other node on the internet. Links to such materials are prohibited. This includes, but is not limited to illegal adult sites, fraudulent schemes, warez software, hacker programs/archives, and illegal MP3 files.

E-mail
The sending of unsolicited e-mail, also known as SPAM, from Tinyhosts servers or referencing a web site or e-mail address hosted by Tinyhosts in any unsolicited e-mail, whether originating from Tinyhosts servers or not, is strictly forbidden. Tinyhosts will be the sole arbiter as to what constitutes a violation of this provision. Tinyhosts will not host accounts that utilize safe-lists, opt-in lists, target-lists, or any other service that falsely tries to disguise bulk mailing as non-intrusive. This does not affect genuine mailing lists.

Adult
Web sites containing “adult” content of any-sort or that link to other sites containing “adult” content are strictly prohibited. Tinyhosts will be the sole arbiter as to what constitutes a violation of this provision.

Free Services
No services provided by Tinyhosts may be used to provide free resources, this includes, but not limited to e-mail addresses, web space, e-mail or domain redirecting, DNS, shopping carts and remote script hosting. This does not prevent users from using external services such as Everyone.net and BigMailBox or any other third-party hosted solution that provide free resources to visitors.

Add-on and Parked Domains
Reselling of add-on domains is strictly prohibited; account holders are solely responsible for all add-on and parked domains utilized. Account holders can not delegate responsibility to any other company or individual. Use of any software or technique to run multiple web sites outside the add-on and parked domain allowance is strictly prohibited.

Shell Access
As a security measure shell access is granted on a case by case basis, users must have a valid reason to request shell access. If approved Tinyhosts will require a faxed copy of client’s passport or drivers license, a signed copy of these terms and conditions and the front/reverse of credit card used for payment. This is also applicable to resold accounts.

Background Running Programs
Programs that run continually in the background are forbidden.
Port forwarders are NOT allowed under any circumstances.

IRC
We currently DO NOT allow IRC, IRC bouncers, IRC bots, egg drops, or similar software to be operated on our servers.

Proxy Server Software
We do not permit the running of software that hides you or your customers access of the internet the use of Proxy server software on our servers is strictly prohibited.

Accessing Other Systems
We do not allow illegal or unauthorized access to other computers or networks belonging to another party, or attempts to penetrate security measures of another individual’s system (often known as “hacking”). We also do not allow any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

Server Abuse
Any attempts to undermine or cause harm to any Tinyhosts server or client of Tinyhosts is strictly prohibited. Tinyhosts holds no responsibility for the use of our clients’ accounts. Any account the abuses resources and actions are not taken to desist, calls for immediate de-activation without any refund of payments made thus far. Any site using what we deem to be using excessive CPU cycles or any resources that cause strain to other sites may also be offered new terms. We strongly encourage users to code in PHP or use pre-written PHP scripts rather than Perl or CGI, as experience has shown us that in our current setup PHP runs considerable faster than Perl or CGI and rarely causes any resource issues.

Message Boards
CGI message boards, are strictly prohibited as they are well known to be drain on system resources, this includes, but is not limited to Ultimate Bulletin Board (UBB), Ikonboard, and YaBB. This does not affect message boards written in PHP.

Data Transfer
Each account is allocated a specified amount of data transfer, also referred to as bandwidth, per calendar month. If data transfer exceeds the specified amount we will automatically bill excess data transfer to the next bill. Optionally Tinyhosts can cap accounts to a certain amount of data transfer, ensuring no excess billing, requests for a data transfer cap must be sent to accounts@Tinyhosts.com.

Additional data transfer is billed at $3.50 per gigabyte. Accounts utilizing more than 75gb a month of data transfer are encouraged to utilize our dedicated services.

Backups
Daily backups of client data and periodic backups of critical system files for emergency purposes.

Despite our backup procedure being very fault tolerant clients should not rely on Tinyhosts to perform site/data backups for them and clients are ultimately responsible for backing up their own data.

An easy-to-use instant backup facility is available via the client’s online control panel. MySQL data dumps can be easily performed by the client via the included phpMyAdmin. Clients are advised to backup all of their own files to their local drives. Tinyhosts is NOT responsible for lost data, time, income or any other resource due to hardware failure, faulty backups or non-existant backups.

Billing
The first payment is due at the time of ordering, unless otherwise arranged this will be charged to credit card specified at the time of ordering. Subsequent payments are due every 30 days or 365 days from this date, dependent on which billing cycle is selected, unless otherwise specified this will automatically be charged to the credit card on file.

Clients are responsible for ensuring their credit card details on file are up-to-date. Accounts five days past due will be de-activated. Accounts ten days past due will be deleted from the server.

Any chargebacks or fraudulent payments will be dealt with very seriously, we reserve the right to forward any owed debts to any chosen debt collection agency, whom will add their fee and interest to the total, this may also affect client’s credit rating. We work with multiple debt collection agencies, in various countries, to ensure this policy is not exploited.

Cancellation
Cancellations can be made via e-mail to accounts@Tinyhosts.com stating the account username and domain name. In addition clients must provide an account password in order for us to verify the request. Although no notice is required, and there is no cancellation fee, all fees paid for service up to the point of cancellation are non-refundable.

We reserve the right to remove any account without prior notice for any reason.
Accounts in violation of these terms and condition will not be entitled to a refund.

Refusal of ServiceWe reserve the right to refuse, cancel, or suspend service at our sole discretion.

In no event will Tinyhosts be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use Tinyhosts or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.
